La justicia indígena en la Zona Jalifiana del Protectorado español en Marruecos

Abstract

Se describen los rasgos fundamentales de la justicia indígena de la Zona Jalifiana del Protectorado español en Marruecos, dejando de lado la situación de la justicia consuetudinaria del Rif. Se incide en su relación con la justicia en Marruecos antes del Protectorado, en la Zona Cherifiana y la posterior a 1956. Se concluye que, aunque es la justicia indígena de la zona francesa la que en mayor medida marcará el futuro de la Administración de Justicia independiente, la analizada tiene una personalidad propia en la Historia del Derecho en Marruecos, y refleja las características de la acción colonial española.

This article briefly describes the indigenous Justice of the Chaliphian Zone during the Spanish Protectorate in Morocco. The situation of the customary Justice of the Rif is left aside. We refer to, firstly, its relation with the Justice in Morocco before the instauration of the Protectorate, secondly, with the Justice in the French Zone, and, finally, with the Justice after the independence. We come to the conclusion that, although the indigenous Justice of the French Zone is the one that will mark the future of Moroccan independent Justice, the analysed one has its own personality in the History of Law of Morocco, and it reflects the features of the Spanish colonial action.
