La arquitectura institucional de la Unión Europea. Consideraciones críticas tras su reforma en Tratado de Lisboa

Abstract

El sistema institucional diseñado en Lisboa, fruto de la transacción entre los intereses de los Estados y los generales de la Unión, expresa la voluntad de encuentro de una fórmula de equilibrio institucional, que aparece sujeta a una permanente tensión dialéctica. Será así la dinámica predominantemente intergubernamental o federal del sistema la que acabará dando forma y consistencia perdurable al mismo. Y es que el Tratado de Lisboa no modifi ca el modelo o forma de gobierno existente. Más bien, cabe constatar una profundización en la misma. De ahí que subsistan sus contradicciones y carencias. A lo sumo, se racionaliza el funcionamiento de las instituciones, adaptándolas a las dimensiones adquiridas por la Unión Europea, tras su ampliación a los nuevos Estados miembros. Pero se sigue lejos de cumplir con el propósito tendencial que aspira a que el proceso de integración europea se sustente, plenamente, de acuerdo con una organización federal, en la voluntad de los ciudadanos, promoviendo su participación política activa, directamente o a través de las instituciones. The institutional system of the European Union made up by the Lisbon Treaty expresses the transaction between the States interests and the general interests of the Union. This institutional balance suffers a constant threat. Therefore, it will be the federal or the intergovernmental dynamic of the system that, in the end, will give it a consistent and durable shape. The Treaty of Lisbon does not modify the existing frame of government, but it does go into the topic in depth; that is the reason the contradictions and defi ciencies of it subsist. Nevertheless, we may verify a more complete rationalisation of the institutional competences and a more visible interaction of the institutions considered. Specifi cally, now they are better adapted to the new and wider geographic dimensions of the European Union. But we are still far from reaching the goal that expresses the ambition to shape a federal organisation fully based on the European democratic willpower.
