La présente contribution analyse les avancées du droit européen
par rapport à la protection des femmes victimes de violence conjugale, en examinant
en particulier le sort de femmes étrangères ressortissantes d’États
tiers et dont la situation migratoire est précaire. Dans un premier temps,
l’analyse se concentre sur les conséquences de la condition de victime de
violence de genre sur le statut de résident de la victime. Dans un deuxième
temps, l’analyse se tourne vers les actions civiles que peuvent engager les
ressortissantes étrangères pour des faits de violence liée au genre. Enfin,
la contribution aborde aussi la question de la mobilité internationale pour
des femmes étrangères victimes de violence domestique. This contribution analyzes the progress of European law
in the protection of women victims of domestic violence, by examining in
particular the fate of foreign women who are third-country nationals and
whose migratory situation is precarious. In the first instance, the analysis
focuses on the consequences of being a victim of gender violence on the
victim’s residence status. Secondly, the analysis turns to the civil actions
that foreign nationals can bring for gender-based violence. Finally, the
contribution also addresses the issue of international mobility for foreign
women victims of domestic violence.
