El derecho humano al agua y al saneamiento

Abstract

A pesar de movernos en un contexto de cambio climático y tratarse el agua de un elemento esencial para la supervevivencia de todos los seres vivos siendo el sustrato previo para el desarrollo de otros derechos (como el derecho a la vida, derecho a una alimentación adecuada, derecho a la salud o derecho al trabajo) lo cierto es que el derecho al agua y al saneamiento no se haya reconocido, ni con carácter de mínimos, en diversos textos constitucionales, lo que a nuestro juicio resulta muy paradójico. La finalidad de esta investigación es llamar la atención sobre esta cuestión a la par que poner de manifiesto una tendencia positivista de este derecho que comienza a reconocerse en diversos textos jurídicos, incluso de corte constitucional, y, en definitiva, defender la necesidad de intervención por parte de los poderes públicos en esta materia.

Despite we are in a context of climate change, water being an essential element for the survival of all living beings and a prior base for the development of other rights (such as the right to life, the right to adequate food, the right to health or the right to work) the truth is that the right to water and sanitation has not been recognized, even as a minimum, in various constitutional texts, which in our opinion is very paradoxical. The purpose of this research is to draw attention to this issue at the same time as to highlight a positivist tendency of this right that is beginning to be recognized in various legal texts, including constitutional ones, and, ultimately, to defend the need for intervention by part of the public powers in this matter.
