Abstract
Despite we are in a context of climate change, water being an essential element
for the survival of all living beings and a prior base for the development
of other rights (such as the right to life, the right to adequate food, the
right to health or the right to work) the truth is that the right to water and
sanitation has not been recognized, even as a minimum, in various constitutional
texts, which in our opinion is very paradoxical. The purpose of this
research is to draw attention to this issue at the same time as to highlight a
positivist tendency of this right that is beginning to be recognized in various
legal texts, including constitutional ones, and, ultimately, to defend the need
for intervention by part of the public powers in this matter.
