La protección del menor a través del régimen de guarda y custodia

Abstract

The adaptation of family law to the evolution of society implies the need for a resizing of the principles that inspire it and, therefore, of everything related to the protection of minors in this area. The main objective of this work is the analysis of the situations in which minors may find themselves, when their care and custody is configured as the basic protection system for them. Starting from the best interest of the minor and a general approach to the legislative options that exist, measures such as shared custody are analyzed, focused on the concept of mutual respect of the parents, the exercise of guardianship and custody by a third person, and the protection of minor victims in situations of gender violence and its impact on custody.

La adaptación del Derecho de familia a la evolución de la sociedad supone la necesidad de un redimensionamiento de los principios que lo inspiran y, por tanto, de todo lo referente a la protección del menor en este ámbito. El objeto principal de este trabajo, versa sobre en el análisis de las situaciones en que pueden encontrarse los menores, cuando la guarda y custodia de los mismos se configura como el sistema básico de protección hacia ellos. Partiendo del interés superior del menor y de un planteamiento general sobre las opciones legislativas que existen, se analizan medidas como la custodia compartida, centrada en el concepto de respeto mutuo de los progenitores, el ejercicio de la guarda y custodia por una tercera persona, y la protección del menor víctima en situaciones de violencia de género y su repercusión en la custodia.
