Convenio sobre el trabajo en la pesca 2007 (núm. 188)

Abstract

El trabajo a bordo de buques pesqueros presenta unas singularidades propias que le caracterizan y diferencian del que pueda llevarse a cabo en cualquier otro sector. De ahí la necesidad de una norma específicamente dedicada a regular de manera integral las condiciones de trabajo en una industria que cuenta en la actualidad con más de cuarenta millones de trabajadores en el mundo. El Convenio n. 188 sobre el trabajo en la pesca (2007), que se hizo esperar más tiempo del que hubiera sido deseable, fue adoptado con el objeto de garantizar que los pescadores gozasen de condiciones de trabajo decentes a bordo de los buques pesqueros. En este artículo se ofrece un análisis de dicho instrumento normativo con el fin de determinar sus virtudes y carencias, todo ello a la luz de los retos que plantean las específicas condiciones del trabajo marítimo- pesquero.

Work on board fishing vessels has significant singularities which characterize and distinguish it from that which is carried out in any other sector. Hence, the need of a standard relating specifically and in a comprehensive manner the working conditions in an industry that currently employs more than forty million workers around the world. Convention n. 188 concerning work in the fishing sector (2007), whose adoption took longer than desirable, has the objective to ensure that fishers have decent conditions of work on board fishing vessels. This paper provides an analysis of this ILO standard-setting instrument in order to identify its strengths and weaknesses, all this in the light of the challenges that the specific working conditions in the sea fishing sector pose.
