Los delitos de traición al estado e incitación a la guerra: sus relaciones concursales con otros preceptos de los Códigos penales común y militar.

Abstract

Los delitos de traición al Estado y de incitación a la guerra, contenidos en los artículos 581 a 588 del Código Penal de 1995 (Título XXIII, Libro II) son algunos de los preceptos más olvidados y, por fortuna, menos aplicados de nuestro texto punitivo vigente. Su análisis detenido resulta, sin embargo, muy recomendable teniendo en cuenta los diversos problemas interpretativos que plantean, especialmente en cuanto a sus relaciones concursales con otros delitos conexos previstos en el CP común (así, con los arts. 590 a 592, 595 a 598) y en el CP militar (arts. 24 a 26 y 57). Por otra parte, la actual inestabilidad del panorama internacional, singularmente con el conflicto desencadenado entre la Federación Rusa, Ucrania y los países de la OTAN, invita a revisitar estos delitos de traición, espionaje e incitación a la guerra ante la posibilidad de una mayor importancia de los mismos en el futuro

The crimes of treason against the State and incitement to war, contained in articles 581 to 588 of the Spanish Penal Code 1995 (in its 2nd Book, Title XXIII) are some of the most forgotten precepts and, fortunately, also very scarcely applied in our punitive text. It is, however, highly recommended to analyze them carefully, taking into account the various interpretative problems that they cause. Especially, it is difficult to distinguish between t hose precepts and other related crimes provided for in the common Penal Code (articles 590 to 592, 595 to 598) and in the military Penal Code (articles 24 to 26 and 57). On the other hand, the current instability of the international scene, particularly with the conflict raised between Russia, Ukraine and the NATO countries, suggests the convenience of revisit this crimes of treason given the possibility of their greater relevance in the future.
