Curatela na Justiça de Família do Estado de Goiás (Brasil): Trabalho do Assistente Social na Promoção da Cidadania

Abstract

O artigo, tomando por base alguns dos resultados obtidos na pesquisa realizada no Brasil no âmbito do mestrado em Serviço Social (ISMT/Coimbra, Portugal), procura problematizar e refletir sobre as mediações presentes na intervenção dos assistentes sociais enquanto peritos em ações judiciais de curatela. Discute e analisa a trajetória da interdição civil e curatela no Brasil e a inserção/percurso dos assistentes sociais enquanto peritos nesses processos judiciais. Objetiva compreender como, no seu agir quotidiano, os assistentes sociais se podem consubstanciar como defensores dos direitos e, promotores da cidadania dos cidadãos curatelados e suas famílias. Optou-se por uma abordagem qualitativa, e o procedimento metodológico utilizado para coleta do material empírico foi o inquérito por questionário aos profissionais do Tribunal de Justiça do Estado de Goiás. Os resultados concluem que, ao não se limitarem a avaliar as capacidades do interditando para a prática de atos da vida civil, os profissionais contribuem para uma melhor compreensão das limitações, condicionalismos presentes na realidade social dos sujeitos e das suas potencialidades. Uma das principais contribuições deste estudo reside na identificação e análise das práticas que, ao desvelarem a condição de necessidade, desproteção dos sujeitos, se constituem como defensoras dos seus direitos e potenciadoras da cidadania.

Based on some of the results obtained in the research carried out in Brazil within the master’s degree in Social Work (ISMT/Coimbra, Portugal), the paper seeks to problematize and reflect on the mediations present in the intervention of social workers as experts in legal actions of guardianship. Discusses and analyses the trajectory of civil interdiction and guardianship in Brazil and the insertion/career of social workers as experts in these judicial processes. It aims to understand how, in their daily activities, social workers can embody themselves as defenders of rights and promoters of the citizenship of curated citizens and their families. A qualitative approach was chosen, and the methodological procedure used to collect the empirical material was a survey to professionals from the Court of Justice of the State of Goiás. The results conclude that, by not limiting themselves to evaluating the capabilities of the interdicted person to practice acts of civil life, professionals contribute to a better understanding of the limitations, constraints present in the social reality of the individuals and their potential. One of the main contributions of this study lies in the identification and analysis of practices that, by revealing the condition of necessity, lack of protection of people, constitute themselves as defenders of their rights and enhancers of citizenship.
