La regulación y la gestión del Patrimonio Histórico-Artístico durante la Segunda República (1931-1939)

Abstract

El objeto de este artículo es ofrecer una visión unitaria del régimen jurídico y la gestión del patrimonio durante el periodo republicano. Para ello, analiza de forma exhaustiva no sólo las leyes más importantes que se promulgaron en este periodo, como la ley republicana de 1933 y sus antecedentes, sino también aquellas otras instrucciones, ordenanzas y decretos que fueron pormenorizando el estatus legal del patrimonio. Estudia también la estructura orgánica de las administraciones e instituciones que tenían las competencias en su protección, profundizando especialmente en los cambios acaecidos en las mismas y en el caso concreto de la Real Academia de Bellas Artes. De este modo, consigue hacer una lectura completa del modelo cultural republicano y de las circunstancias históricas y políticas que condicionaron la complicada gestión del patrimonio durante la Segunda República.

The aim of this article is to offer a unitary vision of the legal regime and management of heritage along the Second Republic in Spain. Not only does it analyze in depth the most important laws of protection of the period, as the republican law of 1933 and its backgrounds, but also those other orders, instructions and provisions that completed the legal regime of heritage. It also gives an extensive approach to the administrations and institutions that had the competences on protection of heritage and their organic evolution, deepening especially in the changes they suffered and in the Royal Academy of Fine Arts situation. In this way it offers a complete lecture of the republican cultural model and the historic and politic circumstances that conditioned the complicated administration of heritage during the Second Republic.
