La inducción al suicidio y a las autolesiones de menores y otros sujetos vulnerables a través de las TICs

Abstract

Los riesgos que se derivan de la utilización del internet por parte de los menores y otros sujetos vulnerables están cada vez más presentes en la sociedad. Por este motivo, se introducen en nuestro ordenamiento jurídico normas dedicadas a paliar las con-secuencias negativas que pueden derivarse del uso de la red. La Ley Orgánica 8/2021, de 14 de junio, de protección integral a la infancia y la adolescencia frente a la violencia, ha incorporado en el Código Penal, entre otros, los delitos de inducción al suicidio y a las autolesiones a través de las TICs (arts. 143 bis y 156 ter CP, respectivamente). La entrada de estas figuras delictivas en el Código penal ha sido muy discutida por varias razones. En primer lugar, se debate si la introducción de los delitos en la norma penal responde verdaderamente a razones político-criminales; y en segundo lugar, si tales comportamientos podrían haberse sancionando aplicando delitos que ya se encontraban en el Código Penal. Además, desde el plano técnico se pueden identificar algunos errores en la configuración de los preceptos que contienen estos ilícitos, dando lugar a problemas interpretativos. Sobre estas cuestiones, y otras más específicas, trata este trabajo. Con el presente artículo tratamos de estudiar la pertinencia de los delitos señalados, analizar su contenido y, finalmente, realizar propuestas al respecto.

The risks arising from the use of the internet by minors and other vulnerable subjects are increasingly present in society. For this reason, regulations have been introduced in our legal system to mitigate the negative consequences that may arise from the use of the internet. Organic Law 8/2021, of 14 June, on the comprehensive protection of children and adolescents against violence, has incorporated into the Criminal Code, among others, the crimes of inducing suicide and self-harm through ICTs (arts. 143 bis and 156 ter CP, respectively). The inclusion of these offences in the Criminal Code has been much debated for several reasons. Firstly, there is a debate as to whether the introduction of the offences in the criminal law truly responds to political-criminal reasons; and secondly, whether such behaviours could have been punished by applying offences that were already in the Criminal Code. Moreover, from a technical point of view, some errors can be identified in the configuration of the precepts that contain these of-fences, giving rise to interpretative problems. These and other more specific issues are the subject of this paper. The aim of this article is to study the relevance of these offences, to analyse their content and, finally, to include a proposal in this respect
