Programa de Doctorado en Lenguas, Textos y Contextos This doctoral thesis carries out a legal study of the phenomena of deprivation of liberty such as captivity and slavery, focused on the Christian territories of the Crown of Castile, Aragon, the Italian commune of Genoa, as well as the Islamic emirates of Granada and the Maghreb, during the 15th century. This is accomplished from a comparative perspective which highlights the differences and similarities between them. The terms captive and slave, which are often confused, are also defined. Although this is a subject that has been widely studied by various authors, the research deals with different disciplines, particularly economic and commercial history, as well as focusing on specific geographical areas. Therefore, our choice responds to the absence of a thorough legal study of these realities, as well as of a broader geographical perspective that would allow us to address the gaps in research, resulting from the scarcity of information from sources. As a result of our previous investigations, our starting hypothesis is the possible existence of common legal aspects in deprivation of liberty –captivity and slavery– which would lead to a certain political and legal consensus between two civilizations with different traditions. Hence, the main objective of this research is to establish the similarities and legal differences between the phenomena of deprivation of liberty, captivity and slavery, through a legal comparison of the different territories. In turn, a number of specific objectives have been set for this work, such as: I. To define the captive and slave terminology and its evolution. II. To provide possible answers to the indistinct use of terms referring to deprivation of liberty. III. To understand the reasons for deprivation of liberty on the basis of political and economic interests, including religious ones. IV. To analyse the ways in which people become slaves and/or captives from a legal point of view, as well as their spaces. V. To establish the relationship between those responsible for regulating legal issues of deprivation of liberty and political and economic interests. VI. To analyse the materialisation of legal and political decisions associated with this question in treaties, fatwas, agreements… VII. To study the impact of the regulations agreed by the states and those specific to each legal order. This has been accomplished by analysing and comparing the legal systems of the various territories that this thesis concerns itself with, which has required a collection of documentary material and studies. In these sources, we can find the current legislation in each territory and also its implementation in certain cases. Thus, the thesis is divided into four chapters which correspond to the objectives mentioned above. Furthermore, we add the introduction, the status of the issue and final conclusions. This research shows the functioning of the different legal structures as well as the terms used for the concepts of deprivation of liberty: captivity and slavery. It also provides an analysis and proposals of the circumstances leading to confusion of these terms and their indifferent use. This is necessary to warn the reader that the terms found throughout the following pages will not always correspond with the reality studied.
