El enfoque de género en la sustracción internacional de menores

Abstract

Los debates sociales y jurídicos abiertos sobre los supuestos de sustracción internacional de menores en los que concurra una situación de violencia de género obligan a reflexionar críticamente sobre los motivos y/o reticencias de reconocer a este tipo de casos como violencia de género. Y es que en la regulación del desplazamiento internacional de menores resulta evidente la inexistencia de perspectiva de género, tal y como se puede comprobar en el CLH 1980 o el RBr. II bis, entre otros textos. No obstante, es preciso tener en cuenta que España se encuentra vinculada por el Convenio de Estambul sobre prevención y lucha contra la violencia contra las mujeres y la violencia doméstica de 11 de mayo de 2011, donde el concepto de violencia contra las mujeres abarca también a la protección a los hijos, reconociendo que los niños y niñas pueden ser víctimas de la violencia machista, incluso como testigos de violencia dentro de la familia. Para alcanzar este objetivo y dar visibilidad jurídica a estas situaciones de naturaleza tan delicada, resulta conveniente que en este artículo se precise, en primer lugar, la perspectiva de género en la normativa sobre la sustracción internacional de menores que vincula a España y el impacto en los procesos de secuestro internacional de menores originados por la violencia de género. Posteriormente, se va a analizar el tratamiento de esta cuestión en la jurisprudencia española. Las respuestas a cada una de estas cuestiones van a situar en el centro del debate el interés del menor cuando ha sido sustraído por su progenitora en contextos de violencia de género, así como la obligación de tomar medidas legislativas adaptadas a estas nuevas realidades vinculadas a la violencia sobre la mujer y el impacto sobre sus hijos.

The open social and legal debates on cases of international child abduction in which a situation of gender violence occurs force us to critically reflect on the reasons and/or reluctance to recognize this type of case as gender violence. And the fact is that in the regulation of the international movement of minors the lack of a gender perspective is evident, as can be seen in the CLH 1980 or the RBr. II bis, among other texts. However, it must be taken into account that Spain is bound by the Istanbul Convention on the prevention and fight against violence against women and domestic violence of May 11, 2011, where the concept of violence against women also covers the protection of children, recognizing that boys and girls can be victims of sexist violence, even as witnesses of violence within the family. To achieve this objective and give legal visibility to these situations of such a delicate nature, it is advisable that this article specify, first of all, the gender perspective in the regulations on international child abduction that binds Spain and the impact on the processes of international kidnapping of minors caused by gender violence. Subsequently, the treatment of this issue in Spanish jurisprudence will be analyzed. The answers to each of these questions will place at the center of the debate the interest of the minor when he has been abducted by his parent in contexts of gender violence, as well as the obligation to take legislative measures adapted to these new realities linked to violence against women and the impact on their children.
