Las instituciones del Derecho concursal. Revisión histórica y crítica

Abstract

El Derecho concursal es un sector muy complejo del ordenamiento tanto por su dificultad técnica como por su singular proceso de evolución. En esta obra se propone una reconstrucción historiográfica y crítica completa de sus instituciones, que abarca desde sus orígenes más remotos hasta la actualidad –y más allá–. Esta tarea implica profundizar en realidades muy diferentes –y distantes en el tiempo–: el Derecho romano y el Derecho medieval, las tesis de los tratadistas españoles del siglo XVII, la obra legislativa de los consulados de comercio, la codificación y descodificación, y por supuesto el continuado proceso de reforma de esta disciplina en los últimos tiempos. Insolvency law is a very complex sector of the legal system due to both its technical difficulty and its unique process of evolution. This work proposes a complete historiographical and critical reconstruction of its institutions, from its most remote origins to the present day - and beyond. This task involves delving into very different - and distant in time - realities: Roman Law and Medieval Law, the theses of the Spanish treatises of the 17th century, the legislative work of the consulates of commerce, codification and decodification, and of course the continuous process of reform of this discipline in recent times.
