El estudio evidencio dos cuestiones de calado. La primera, que el ordenamiento español no contaba con sistemas de tutela alternativos para resolver las controversias colectivas, pues ni el denominado “arbitraje colectivo” recogido en el Real Decreto 231/2008, de 15 de febrero, por el que se regula el Sistema Arbitral de Consumo, ni el contrato de transacción previsto en los arts. 1809 y ss. del Código Civil, representan una alternativa real a la vía judicial en conflictos colectivos. La segunda, poner de relieve que el disperso modelo judicial español de acciones colectivas se separa en varios aspectos del modelo europeo abordado en la Recomendación 2013/396/UE, sobre los principios comunes aplicables a los mecanismos de recurso colectivo de cesación o de indemnización en los Estados miembros en caso de violación de los derechos reconocidos por el Derecho de la Unión Europea, sobre todo en relación con mecanismos de participación, alcance de la cosa juzgada, definición de los intereses colectivos protegidos, entre otras. Todas estas cuestiones han sido detenidamente analizadas en esta contribución y han dado lugar a importantes propuestas de lege ferenda con la finalidad de acompasar las regulaciones internas con las directrices europeas.
