La inteligencia de la complejidad en el Derecho constitucional

Abstract

Ha aprendido a navegar el Derecho constitucional entre diferentes lógicas en la era de los ordenamientos multinivel y del diálogo entre jurisdicciones. El constitucionalismo de nueva generación es un constitucionalismo procedente de varios lugares, de distintos soberanos o momentos constituyentes. Cada cierto tiempo aparecen ideas capaces de abrir nuevos horizontes, simplemente cambiando nuestra forma de observar el Derecho constitucional (la idea del Derecho dúctil, la idea del Derecho constitucional como cultura, etc.). Frente a esta pluralidad de horizontes, la posición del constitucionalista es inalienable, pero no inamovible. Es necesario conjugar este nuevo factor, lo complejo, que nos permite desordenar nuestra mirada de forma organizada al Derecho constitucional para comprenderlo mejor.

The complexity of Constitutional Law must be studied as a problem of scientific thinking since we find ourselves in a constitutionalism which comes from different places as well as different sovereigns, that is capable of using different logics in the time of multilevel law systems and the mutual relationship between different jurisdictions. New ideas appear from time to time, being able to open new horizons in Constitutional Law just by altering our perspective of it (the idea of Diritto mitte, the idea of Constitutional Law as culture, etc.). Law scholars cannot lose their identity but change their point of view. Complex thinking becomes an important alternative for Costitutional Law researchers by first deconstructing it and then rethinking it.
