El Tribunal Constitucional húngaro con posterioridad a la cuarta enmienda de la ley fundamental

Abstract

La revisione della Costituzione della Repubblica dell’Ungheria adottata nel novembre 2010 ha limitato le competenze della Corte Costituzionale ungherese. Tale restrizione fu confermata dalla Legge (CLI del 2011) recante la Corte Costituzionale dell’Ungheria e dal nuovo Testo Costituzionale ungherese entrato in vigore il 1º gennaio 2012 (Legge Fondamentale), in modo che l’autorità della Corte Costituzionale come garante della costituzionalità del sistema giuridico ungherese è venuta indevolita. Come conseguenza delle divergenze tra la Corte Costituzionale e la coalizione di governo Fidesz-KDNP, il Quarto Emendamento della Legge Fondamentale ha gravi ripercussioni sul ruolo della Corte Costituzionale su diversi aspetti.

The constitutional amendment adopted in November 2010 restricted the competences of the Hungarian Constitutional Court. The curtailment of the Court’s powers was confirmed both by Act (CLI of 2011) on the Constitutional Court of Hungary and by the new Constitution of Hungary enacted on January 2012 (Fundamental Law), undermining the authority of the Constitutional Court as a guarantor of constitutionality of the Hungarian legal order. As a result of an in-depth lack of understanding between the Hungarian Constitutional Court and the government coalition Fidesz-KDNP, the Fourth Amendment to the Fundamental Law seriously affects the role of the Constitutional Court of Hungary in a number of ways.
