Planificación económica y tutela jurisdiccional

Abstract

La irrupción del ciclo económico desregularizador a partir de 1980 -recién aprobada la Constitución de 1978-, supuso la postergación de la planificación general en España. No obstante, y una vez que concluya el actual ciclo económico, puede ser hasta necesario volver los ojos sobre la planificación económica como institución jurídico-pública. Por ello, ante la posibilidad de la implementación planificadora, consideramos necesario estudiar su tutela jurisdiccional; es decir, los instrumentos de tutela jurisdiccional que ofrece nuestro marco constitucional, conscientes de que la planificación no solo constituye un proceso, sino también puede y debe ser susceptible de revisión jurisdiccional y constitucional, a fin de salvaguardar los derechos y libertades propios del Estado de Derecho.

The irruption of the deregulating economic cycle as of 1980 - the Constitution of 1978 just approved - meant the postponement of general planning in Spain. However, once the current economic cycle is over, it will be necessary to turn our eyes to economic planning as a legal-public institution. Therefore, given the possibility of planning implementation, we consider it necessary to study its jurisdictional protection; that is, the instruments of jurisdictional protection offered by our constitutional framework, aware that planning not only constitutes a process, but can and should also be subject to judicial and constitutional review, in order to safeguard the rights and freedoms of the State of Right.
