Abstract
Este trabajo tiene por objeto reflexionar sobre el segundo requisito de la legítima defensa, legalmente recogido en el artículo 20.4.º del Código Penal, que a día de hoy sigue sin ser pacífico en lo que respecta a si la necesidad racional del medio empleado para impedir o repeler la agresión ilegítima debe ser (o no) interpretado a la luz del principio de proporcionalidad. Desde esta perspectiva, tras ofrecer una breve revisión de la jurisprudencia y de la doctrina científica al respecto, se analizan los aspectos clave para determinar la racionalidad de la defensa, entre los que destaca el examen del principio de menor lesividad y los criterios para valorar dicha racionalidad. Por último, se realiza una aproximación a aquellos supuestos en los que la defensa es irracional por incumplimiento del requisito analizado y que técnicamente dan lugar a la aparición de la figura denominada exceso intensivo o propio.
