Una construcción antropológica del tratamiento jurídico-penal de madres imputadas de masacre familiar

Abstract

Este artículo tiene por objeto una aplicación del conocimiento antropológico al campo de la conflictividad social relativa al quiebre de la ley. Como ejemplo se toma el fenómeno de las madres que matan a sus hijos. Se utiliza la mirada antropológica en dos planos: el tratamiento jurídico-penal que reciben estas mujeres y la posición geopolítica que tienen estas mujeres tanto para cometer este delito como para ser captadas por el sistema penal. Se concluye que la antropología puede colaborar a ponderar, evaluar y hacer públicos el peso conceptual e ideológico en la ponderación de una ofensa de la ley penal, introduciendo como factor decisivo la voz de las propias madres.

This article’s intent is to apply the anthropological knowledge to the field of social conflicts relative to the breaking of the law. It takes as an example the phenomenon of mothers killing their children. The anthropological glance is used at two levels. The first is the penal-judicial processing that these women undergo. The second is the geopolitical position that these women have to commit this crime as well to be caught by the penal system. One concludes that Anthropology can collaborate in order to ponder, to evaluate, and to make public the conceptual and ideological weight in the assessment of a penal law’s offence, introducing the voice of the mothers themselves as a decisive factor.
