Contextos y variables sociales en torno a la custodia tras el divorcio en matrimonios hetero y homosexuales

Abstract

La asignación de la custodia, y las variables que se relacionan con cada una de las modalidades, tras el divorcio es un ámbito de estudio cada vez más recurrente en España (Spijker, 2012; Picontó, 2012; Solsona, Brullet y Spijker, 2014; Becerril, 2014; Solsona, 2015; Flaquer, 2015; Becerril y Jiménez, 2016; Ruiz y Alcázar, 2017; Jiménez et. al., 2021). Sin embargo, la literatura muestra que el interés por esta temática se ha centrado, principalmente, en disoluciones de parejas heterosexuales dejando de lado lo que sucede tras la ruptura de matrimonios compuestos por personas del mismo sexo. A esto se suma la inexistencia de continuidad en trabajos que aborden diversa cantidad de dimensiones (aspectos legales, características de los cónyuges, del matrimonio, entre otras). Por ello, la presente tesis doctoral pretende, para el caso de España, analizar las variables de carácter social que influyen en la asignación de la custodia tras la ruptura de matrimonios heterosexuales y compuestos por personas del mismo sexo. Para ello, como paso previo y necesario, se muestra un esbozo del divorcio y el impacto que han tenido los cambios legales en su evolución. Esto, es condición sine qua non ya que del divorcio depende la cuestión fundamental de la tesis: asignación de la custodia de hijos. Se utiliza metodología mixta. Por un lado cuantitativa, con análisis de tipo descriptivo, bivariante y multivariante, mediante la utilización de estadísticas como el MNP, datos del CGPJ, la EPA y la ENSD del INE. Por otro lado, para la parte cualitativa se hace uso de la entrevista en su modalidad semi-estructurada, llevando a cabo un análisis de discurso. Los hallazgos principales indican que los cambios legales no parecen impactar, en la evolución del divorcio, de forma determinante, aunque es innegable que tienen cierto peso sobre todo a corto plazo. Este hecho se repite con los cambios legales en relación a la custodia de los hijos. Con respecto a la asignación de la custodia, de forma específica, indicar que la modalidad de custodia compartida está más presente en el caso de divorcio de matrimonios compuestos por personas del mismo sexo que en heterosexuales, siendo el número de hijos, la conflictividad en el proceso de divorcio y la Comunidad Autónoma aspectos claves para entender qué modalidad de custodia se asigna.

The allocation of custody, and the variables that are related to the allocation of each of the modalities, after divorce is an increasingly recurrent field of study in Spain (Spijker, 2012; Picontó, 2012; Solsona, Brullet y Spijker, 2014; Becerril, 2014; Solsona, 2015; Flaquer, 2015; Becerril y Jiménez, 2016; Ruiz y Alcázar, 2017; Jiménez et. al., 2021). However, the literature shows that interest in this topic has focused mainly on dissolutions of heterosexual couples, leaving aside what happens after the breakdown of marriages made up of people of the same sex. Added to this is the lack of continuity in work that addresses a diverse number of dimensions (legal aspects, characteristics of the spouses, of marriage, among others). For this reason, this doctoral thesis aims, in the case of Spain, to analyze the variables of a social nature that influence the allocation of custody after the breakdown of heterosexual and same-sex marriages. To do this, as a prior and necessary step, an outline of the divorce and the impact that legal changes have had on its evolution is shown. This is a sine qua non condition since the fundamental question of the thesis depends on divorce: assignment of child custody. Mixed methodology is used. On the one hand quantitative, with descriptive, bivariate and multivariate analyzes, using statistics such as the Natural Population Movement, data from the General Council of the Judiciary (CGPJ), the Active Population Survey and the Statistics of Nullities, Separations and Divorces (ENSD) of the National Institute of Statistics (INE). On the other hand, for the qualitative part, the interview is used in its semi-structured mode, carrying out a discourse analysis. The main findings indicate that legal changes do not seem to have a decisive impact on the evolution of divorce, although it is undeniable that they carry some weight, especially in the short term. This fact is repeated with the legal changes in relation to the custody of children. With regard to the assignment of custody, specifically, indicate that the modality of shared custody is more present in the case of divorce of marriages composed of persons of the same sex than in heterosexual ones, being the number of children, the conflict in the divorce process and the Autonomous Community (CC.AA.) key aspects to understand what type of custody is assigned.
