Unidad y pluralidad del derecho civil: años después

Abstract

Los autores reflexionan sobre las transformaciones experimentadas por el sistema del Derecho civil en el tránsito del siglo XX al siglo XXI, y contrastan las preguntas de hoy con las que ambos enfrentaron en un artículo que también escribieron juntos, con el mismo título, hace cuatro décadas. Constatan un desplazamiento de las fuentes y fundamentos del sistema derivado de cambios ideológicos, tecnológicos, normativos y macropolíticos, y postulan un nuevo diálogo entre la cultura de la codificación y la cultura constitucional que pudiera restañar los deterioros en la entereza y funcionalidad del Derecho privado como factor de estabilidad en el ordenamiento jurídico.

The authors reflect on the changes that have occurred in the civil Law system throughout the twentieth and twenty first century and compare the current questions with those approached in the article that they wrote together, with the same title, four decades ago. They confirm a shift in the sources and the structure of the system derived from ideological, technological, normative and macropolitical changes, and propose a new dialogue between the culture of coding and the constitutional culture that could restore the deterioration in the integrity and functionality of Private Law as a factor of stability in the juridical order.
