dc.description.abstractEste estudio quiere incidir en las cuestiones que presentan las viviendas de finalidad turística, diferenciadas de los alojamientos de carácter hotelero. Los problemas surgen desde distintos frentes. Por un lado, es claro el derecho de los propietarios para hacer uso de su titularidad pero, si la vivienda está sita en un comunidad en propiedad horizontal, la actividad puramente de ocio de los turistas puede ser incómoda o molesta para la vida de los demás residentes; por otro lado, los inconvenientes surgen también en cuanto a la normativa aplicable a estas viviendas ya que, si bien el contrato esencialmente es civil, el legislador estatal -dando un paso atrás- abrió la caja de Pandora, permitiendo que las Comunidades Autónomas y los Ayuntamientos entraran, a través de las competencias en turismo y urbanismo, a regular este tipo de alojamiento. Esto ha supuesto una maraña normativa desigual y confusa en todo el país que, claramente, no es buena para los intereses económicos de España. Somos conscientes que esta situación no tiene vuelta atrás, pero sí se pide un esfuerzo de sentido común a las distintas Administraciones en bien de los propietarios, de los usuarios y de la propia ciudad.es_ES
dc.description.abstractThis study wants to influence the issues presented by tourist housing, differentiated from hotel accommodation. Problems arise from different fronts. On the one hand, the right of the owners to make use of their ownership is clear but if the house is located in a horizontally owned community, the purely leisure activity of tourists can be uncomfortable or annoying for the lives of the others residents; on the other hand, the inconveniences also arise in terms of the regulations applicable to these homes sins although the contract is essentially civil, the state legislator opened the Pandora’s box, taking a step back, allowing the autonomous communities and municipalities to enter, through the competencies in tourism and urban planning to regulate this type of accommodation. This has created an uneven and confusing regulatory tangle throughout the country that is clearly not good for Spain’s economic interests. We are aware that in this situation, there is no turning back but a common sense effort is requested from the different administrations for the good of the owners, the users and the city itself.es_ES
