El médico como garante de los derechos fundamentales

Abstract

Los autores expresan su preocupación por los hechos que están ocurriendo en muchos países desarrollados en los que instituciones del El Estado, bien a través de leyes, bien a través de los Tribunales de Justicia, están usurpando derechos fundamentales de los ciudadanos, tales como: el derecho a decidir sobre sus vidas, el derecho a la huelga de hambre, donde deben ser enterrados, qué vidas merecen ser vividas y cuales no, los limites de los tratamientos médicos. Los autores proponen que en determinadas circunstancias, cuando las personas no pueden dar un consentimiento válido, sean los médicos los que adopten la posición de garantes como los mejores administradores del principio de beneficencia, que es el entraría en ese momento en funcionamiento, una vez que no lo puede hacer el principio de autonomía. Los autores alertan del peligro que supone hoy para el ciudadano, la dictadura de la ciencia, el estado y el hombre mismo en su afán de controlarlo todo.

The authors express their concern about the events happening in many developed countries in which state institutions, through laws or through the courts of Justice, are usurping fundamental rights of citizens, such as: the right to decide about their own lives, the right to hunger strike, to choose where to be buried, about which lives deserve to be lived and which don't, and about the limits of medical treatment. The authors propose that in certain circumstances, when a person is not able to give informed consent, the doctors should be adopting the position of guarantor as the most qualified administrators of the welfare principle, which would be the principle that must be taken into account once the autonomy principle cannot be taken. The authors warn of the danger that science dictatorship, the state, and the individual in his eagerness to control everything could pose for citizens in this modern age.
