Abstract

La sistematica general que ha marcado el desarrollo de la jurisprudencia y la regulación del derecho a la información en el ambito sanitario, merece un analisís crítico, que pueda contribuir a subsanar aspectos contraproducentes en relación con los verdaderos objetivos de la información, que son en definitiva los derechos de los pacientes y de los profesionales. En cambio, los aspectos negativos señalados, pueden ser la burocratización del ejercicio del derecho, la deshumanización del acto, el deficiente conocimiento del paciente o incluso el deficit de información imprescindible para que el médico pueda realizar la mejor praxis. Este artículo simplifica la esencia de los aspectos clave de la materia, y ofrece una pautas que puden servir para mejorar el ejercicio práctico de estos derechos.

The general systematics that has marked the development of case law and the regulation of the right to information in the health field, deserves critical analysis, which can help overcome counterproductive aspects concerning the true aims of information, which are ultimately the rights of patients and professionals. Instead, the negative aspects mentioned may be the bureaucratization of human rights or the right of the patient, the dehumanization of the act, poor knowledge of the patient or even the deficit of essential information to the physician to carry out the best practice. This article simplifies the essence of the key aspects of the subject, and provides guidelines which can serve to improve the practical exercise of these rights.
