Los Nawāzil y géneros relacionados en la literatura jurídica: fetuas y Masā'il

Abstract

La obra de Ibn Sahl es una obra de casos concretos y reales sobre los que se pide la fetua a los muftíes y sobre los que el juez, finalmente, dictamina. A su vez, recoge, en la mayoría de los casos, no en todos, este dictamen (ḥukm) del juez, como había empezado a ser práctica en Al-Andalus con el cadí Ibn Ziyād (s. IX-X).

The work of lbn Sahl is a work of concret and real thigs of which we ask for the fetwa of the muftíes and of which the judge, finally gives his judgement. At the sume time, is takes in the majority of thigs, but not all, this judgement (ḥukm) of the judge, in the way that he began to practice in Al-Andalus with the cadí Ibn Ziyād (s. IX-X).
