Globalisation et souveraineté des États

Abstract

This paper analyzes the concept of state sovereignty to determine how it has been affected by the globalization process. After linking the notion of sovereignty with the exercise of sovereign powers, the study concludes that, at present, the state remains the main center of power in international society and, therefore, remains the central axis around which international law is articulated. Therefore, the validity of the concept of sovereignty as a constituent element of the state and of present international law persists. This should not hinder the identification of vectors of evolution that have shaped this concept, by augmenting the quantitative and qualitative limits of the State in the exercise of its sovereign rights.

Cet article analyse le concept de souveraineté de l'État pour déterminer comment elle a été affectée par le processus de mondialisation. Après lier la notion de souveraineté à l'exercice des compétences souveraines, l'étude conclut que, à l'heure actuelle, l'État reste le principal noyau de pouvoir dans la société internationale et, par conséquent, reste l'axe central autour duquel s'articule le droit international. Par conséquent, la validité de la notion de souveraineté comme un élément constitutif de l'Etat et du droit international actuel persiste. Cela ne devrait pas entraver l'identification des vecteurs d'évolution qui ont nuancée ce concept, en augmentant les limites quantitatives et qualitatives de l'État dans l'exercice de ses droits souverains.
