Facilitation of Digital Access to Justice in Cross-Border Environments: The New System of European Judicial Cooperation in Civil Matters

Abstract

The use of technological tools in cross-border legal processes can improve access to justice, simplify procedures, reduce costs, and accelerate judicial timelines. To achieve this, technological solutions adapted to the cross-border environment and a legal framework that supports their use are necessary through a legal design that guarantees increased efficiency and the protection of fundamental rights. Recently, the European Union has adopted several regulatory instruments to facilitate access to justice in the European cross-border environment through digital means. The system created, which can be explained by the very nature of the European integration process, is not based on creating uniform legislation but on establishing a common minimum framework and coordinating the judicial systems of different countries by applying their national regulations. Nevertheless, we are still in the process of implementing the European digital system, which owing to its complexity, requires phases for its final rollout. The goal of this chapter is to review the innovations in the European system to assess how they respond to the promise of facilitating access to justice that underlies the legislative initiatives adopted and to what extent the model adopted serves as an example for other regional areas. This chapter analyses the elements of the construction of the new European digital system for judicial cooperation in civil matters and describes the challenges it aims to overcome. This chapter also includes proposals for improvement and recommendations for guiding future developments.

El uso de herramientas tecnológicas en los procesos judiciales transfronterizos puede mejorar el acceso a la justicia, simplificar los procedimientos, reducir los costes y acelerar los plazos judiciales. Para lograrlo, se requieren soluciones tecnológicas adaptadas al entorno transfronterizo y un marco jurídico que respalde su uso, mediante un diseño jurídico que garantice una mayor eficiencia y la protección de los derechos fundamentales. Recientemente, la Unión Europea ha adoptado varios instrumentos normativos para facilitar el acceso a la justicia en el entorno transfronterizo europeo a través de medios digitales. El sistema creado, que se explica por la propia naturaleza del proceso de integración europea, no se basa en la creación de una legislación uniforme, sino en el establecimiento de un marco mínimo común y en la coordinación de los sistemas judiciales de los distintos países mediante la aplicación de sus normativas nacionales. No obstante, aún nos encontramos en el proceso de implementación del sistema digital europeo, que, debido a su complejidad, requiere de fases para su implantación definitiva. El objetivo de este capítulo es examinar las innovaciones del sistema europeo para evaluar en qué medida responden a la promesa de facilitar el acceso a la justicia que subyace a las iniciativas legislativas adoptadas y hasta qué punto el modelo adoptado sirve de ejemplo para otras áreas regionales. Este capítulo analiza los elementos de la construcción del nuevo sistema digital europeo de cooperación judicial en materia civil y describe los retos que pretende superar.
