Abstract

Afrontar el estudio de cualquier organismo autónomo de carácter administrativo, como es el Servicio Andaluz de Empleo, siempre requiere adoptar una visión más de política del derecho característica que de técnica jurídica analítica. Como parte de la política de empleo andaluza, se plantean unas controversias respecto a su potencialidad y funcionamiento. No hay una claridad en sus roles. Aparece en mucha normativa interna, programas y planes de actuación. La cuestión es a qué nivel decisorio en materia de intermediación laboral, bien directa o indirectamente resultado de una interpretación de conjunto. El que el Servicio Andaluz de Empleo venga a materializar el derecho social al trabajo constitucionalmente reconocido y otro derecho social al empleo, junto a otros derechos laborales inespecíficos, ha de constituirse en el eje de su actuación acotada en el marco de la administración laboral partícipe en la política de empleo.

Facing the study of any autonomous administrative body, such as the Andalusian Employment Service, always requires adopting a vision more of a characteristic policy of law than of an analytical legal technique. As part of the Andalusian employment policy, some controversies arise regarding its potential and operation. There is no clarity in their roles. It appears in many internal regulations, programs and action plans. The question is at what decision-making level in matters of labor intermediation, whether directly or indirectly the result of an overall interpretation. The fact that the Andalusian Employment Service comes to materialize the constitutionally recognized social right to work and another social right to employment along with other nonspecific labor rights must become the axis of its limited action within the framework of the labor administration participating in the policy of employment.
