Inteligencia artificial y empleo. Análisis crítico del marco regulatorio europeo y español impulsado por el Pilar Europeo de Derechos Sociales

Abstract

Aunque el Pilar Europeo de Derechos Sociales (PEDS) no recoge referencia alguna a la a la Inteligencia Artificial (IA) potencialmente lesiva en el ámbito del empleo, el Plan de Acción del PEDS 2021 sí lo hace de forma expresa, al concretar las acciones y objetivos para desarrollar y concretar los principios establecidos por aquél. De este modo, el PEDS ha servido de impulso de un marco regulatorio europeo y nacional, aún en construcción, enderezado a garantizar el uso ético, fiable y respetuoso de derechos sociales fundamentales de la ciudadanía en general y de las personas trabajadoras en particular. El análisis crítico de la disciplina jurídica de la IA en los ordenamientos europeo y español, objeto de este estudio, centrado en su proyección en el ámbito del empleo y la protección social, incide en sus progresos y debilidades, en el cumplimiento del objetivo de servir de escudo protector de derechos y garantía de condiciones de vida y trabajo seguras y justas (uno de los principios basilares del PEDS) frente a la digitalización basada en la Inteligencia Artificial.

Although the European Pillar of Social Rights (PEDS) does not include any reference to protection against harmful artificial intelligence in the field of employment, the Action Plan PEDS 2021 does so expressly by specifying the actions and objectives to develop and implement the your Principles. In this way, the PEDS has served as an impetus for a European and national law framework, still under construction, aimed at ensuring the ethical and respectful use of fundamental social rights of citizens in general and working people in particular. The critical analysis of the legal discipline of AI in the UE and Spanish legal systems, the object of this study, focused on its projection in the field of employment and social protection, allows to detect and influence their progress as well as their weaknesses in fulfilling the objective of serving as a protective shield for the guarantee of safe and fair living and working conditions against digitization based on Artificial Intelligence, one of the basic principles of the PEDS.
