Problemas prácticos que se plantean en el reconocimento de los divorcios notariales latinoamericanos en España

Abstract

Litigation in matrimonial matters involving an element of foreign nationality is nowadays relatively frequent. Precisely, in recent times, the number of Latin American states has increased considerably and, in view of the need to relieve and speed up the work of the courts in this area, they have de-judicialised the dissolution of the marriage bond. The aim of this study is to analyse the practical problems that arise when notarial divorces granted in Latin America are recognised in Spain. From a methodological point of view, the study analyses both the regulations and the existing Spanish case law on the subject. The result is to highlight the practical difficulties that exist in Spain when it comes to recognising Latin American notarial divorces in Spain, as well as to warn of the problems of application and interpretation that the Spanish regulations pose. This is an original work, as there are no previous studies. The conclusions highlight the main contributions of the work, which will contribute to a better understanding of the problems involved in the recognition of such divorces in Spain.

Los litigios en materia matrimonial en los que concurre un elemento de extranjería son hoy en día relativamente frecuentes. Precisamente, en los últimos tiempos ha aumentado considerablemente el número de Estados latinoamericanos que, ante la necesidad de descargar y agilizar el trabajo de los órganos jurisdiccionales en este ámbito, han desjudicializado la disolución del vínculo matrimonial. El objetivo del presente estudio es analizar los problemas prácticos que surgen al reconocer en España los divorcios notariales otorgados en Latinoamérica. Desde un punto de vista metodológico, el estudio analiza tanto la normativa como la jurisprudencia española existente al respecto. El resultado es evidenciar las dificultades prácticas que existen en España a la hora de reconocer en España los divorcios notariales latinoamericanos, así como advertir los problemas de aplicación e interpretación que la normativa española plantea. Se trata de un trabajo original, pues no existen estudios previos en derecho internacional privado español en este ámbito. En las conclusiones se resaltan las principales aportaciones del trabajo, las cuales contribuirán a un mejor conocimiento de los problemas que presenta el reconocimiento de tales divorcios en España.
