Panorámica sobre los sistemas electorales europeos desde la perspectiva del estado de derecho

Abstract

Los sistemas democráticos europeos descansan sobre el sistema electoral y las garantías y mecanismos que permiten la conformación parlamentaria del pluralismo. La configuración actual de los sistemas electorales europeos evidencia los condicionantes históricos, sociales y políticos que intervienen en su diseño y muestran una clara preferencia por el sistema proporcional frente a la fórmula mayoritaria, con la adaptación de reglas generales a cada caso particular. La preferencia por uno u otro modelo muestra en todo caso, un interesante y clásico debate entre gobernabilidad y representatividad, entre estabilidad, responsabilidad y pluralismo que hoy debe ser revisitado atendiendo a los nuevos factores internos y externos que inciden en el desarrollo de los procesos electorales. Desde estas premisas, este análisis trata de ofrecer una visión panorámica de los sistemas electorales europeos subrayando el protagonismo de la representatividad y del pluralismo en las fórmulas electorales y su potencialidad para responder ante las acciones contrarias a la democracia pluralista y al Estado constitucional de Derecho.

Abstract: The electoral system and the guarantees and mechanisms that allow the parliamentary conformation of pluralism are decisive in European democracies. The notable difficulties surrounding the design of the electoral system are known. Historical, political, and social factors determine the design of a model that in turn seeks to reflect pluralism. The design of current European electoral systems shows these conditions and also a clear preference for the proportional system over the majority formula. The preference for one or the other model shows in any case, an interesting and classic debate between governance and representativeness, between stability, responsibility and pluralism that we must currently revisit. This is due to the new internal and external factors that affect the development of electoral processes. From these premises, this analysis tries to offer a panoramic vision of European electoral systems and underlines the role of representativeness and pluralism in electoral formulas.
