La sociedad de gananciales en el concurso de acreedores

Abstract

El procedimiento concursal conlleva para el deudor, además de las necesarias consecuencias patrimoniales también consecuencias en sus distintos vínculos afectivos, y en mayor medida en el matrimonial. Desde la creación de la institución del matrimonio tiene relevancia en la misma su aspecto económico, que fue presente en mayor o menor medida a lo largo de la historia, pero que nunca desapareció de ella como vertiente fundamental. Se ha podido observar la aparición de las más variadas previsiones para regular los efectos económicos del matrimonio, conocidas como regímenes económicos matrimoniales. En el Ordenamiento Jurídico español rige por excelencia el régimen económico matrimonial de la sociedad de gananciales, al ser el régimen legal supletorio en defecto de pacto. Está claro que en un procedimiento de insolvencia influirá en gran medida el régimen económico matrimonial elegido por los consortes, y que la elección de uno u otro podrá tener consecuencias patrimoniales diferentes.
