Los límites del derecho fundamental a la libertad de expresión en la relación laboral:

Abstract

Analizamos el derecho a la libertad de expresión y sus límites en un mundo global e interconectado. Nos referimos así a la construcción de este derecho fundamental por oposición o confrontación con otros derechos, lo que ha dado lugar a que la libertad de expresión haya sido definida por sus propios límites (que no dejan de ser derechos o bienes dignos de protección constitucional) mediante la técnica de la ponderación de los bienes en conflicto, lo que se ha complicado, aún más si cabe, con las nuevas tecnologías fruto de un mundo global e interconectado, generándose, consecuentemente, una serie de problemas y realidades jurídicas impensables hace años y que también tratamos en esta investigación. Pero, ante el reto de las nuevas tecnologías, la paradoja que se constituye es clara: cuanto más medios existen para desarrollar y hacer efectiva la libertad de expresión, más limitaciones aparecen a este derecho fundamental.

We analyse the right to freedom of expression and its limits in a global and interconnected world. Thus, we refer to the construction of this fundamental right by opposition or confrontation with other rights, what has caused that the freedom of expression has been defined by its own limits (that do not stop being rights or goods worthy of constitutional protection) through the technique of the consideration of the rights in conflict, what has been even more complicated with the new technologies as a result of a global and interconnected world, producing, consequently, a serial of problems and legal realities that were unthinkeable years ago and that we also address in this research. But, considering the challenge of the new technologies, the paradox that it is constituted is clear: the more means there are for developing and making effective the freedom of expression, the more limits are appeared to this fundamental right.
