La filiación de menores nacidos por gestación por sustitución: Situación actual en España y perspectivas de futuro

Abstract

Cada vez es más frecuente establecer la filiación basada en la voluntad o intención a través de la gestación por sustitución, incluso en países que no permiten esta práctica: los comitentes contratan a la gestante en el extranjero y luego reclaman en el país de destino el reconocimiento de la filiación ya establecida, lo que se ve favorecido por la jurisprudencia del Tribunal Europeo de Derechos Humanos y del Tribunal de Justicia de la Unión Europea, que vinculan la filiación a los derechos a la vida privada y familiar y a la identidad, con trascendencia para ejercer la libertad de circulación. Esto parece obligar a respetar la continuidad de la filiación ya establecida, con unas condiciones que están estudiando la Conferencia de La Haya de Derecho internacional privado y la Unión Europea, que se están centrando en el reconocimiento de la filiación, en vez de en la abolición de esta práctica, que suscita innumerables problemas éticos y jurídicos.

It is increasingly common to establish filiation based on the will or intention through surrogacy, even in countries that do not allow this practice: the intended parents hire the surrogate abroad and then claim in the country of destination the recognition of the already established filiation, which is favoured by the jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union, which link filiation with the rights to private and family life and to identity, with significance to exercise freedom of movement. This seems to force us to respect the continuity of the filiation already established, with some conditions that are being studied by The Hague Conference on Private International Law and the European Union, which are focusing on the recognition of filiation, instead of on the abolition of this practice, which raises countless ethical and legal issues.
