La promulgación y entrada en vigor de la Ley 14/2014, de 24 de julio, de Navegación Marítima supuso no solo una modificación en profundidad del ordenamiento marítimo español sino también una actualización del mismo al contemplar aquellas figuras y situaciones obviadas de la práctica marítima.&#13;
El contrato de arrendamiento náutico (también denominado «charter») ha carecido de una regulación legal hasta la fecha. En la actualidad, el Legislador español contempla -entre otras- dicha modalidad contractual en la citada Ley e impone la suscripción obligatoria de un seguro de responsabilidad civil.&#13;
La especificidad jurídica deviene no solo por tratarse de un negocio jurídico con determinadas particularidades sino porque requiere inexcusablemente de la celebración y el mantenimiento en vigor de un concreto tipo de seguro por parte de un arrendador específico dedicado, en exclusiva, a la cesión o puesta a disposición de embarcaciones deportivas o recreativas.&#13;
El incremento en los últimos años de la actividad náutica y del uso de dichas embarcaciones conlleva, con fundamento en una finalidad tuitiva de protección a terceros perjudicados, la exigencia legal de una garantía que cubra los eventuales daños como condición para el ejercicio de la navegación en las aguas marítimas españolas.; The adoption and entry into force of the Act 14/2014, dated 24th July, on Maritime Navigation meant not only a modification thoroughly of the Spanish legal system but also an update of the same one on having contemplated those figures and situations obviated of the maritime practice.&#13;
To date the nautical lease contract (also named «charter») has not had a legal regulation. At present the Spanish Government contemplates -apart from other contractual modalities- this contract in the mentioned Act and imposes the obligatory subscription of a civil responsibility insurance.&#13;
The legal specificity becomes not only because it is a business with certain particularities but because it needs inexcusably of the celebration and the maintenance in force of a concrete type of insurance by a lessor dedicated exclusively to the cession or making the sporting or recreational vessel available. &#13;
The increase in the last years of the nautical activity and of the use of the that vessel involves, based on a purpose of protection to injured third parties, the legal obligation of a guarantee that covers the eventual damages as a condition for the exercise of navigation in Spanish waters.

In the present paper, an examination is undertaken of the legal nature of a special category of the reinsurance contract, namely maritime reinsurance. The study will further address the principal clauses that have progressively been incorporated into policies in order to meet the particular requirements inherent to reinsurance, as well as the issues and implications that such clauses may entail with respect to the traditional functions of the contract, the established relationships between the contracting parties, and, ultimately, the market.&#13;
&#13;
The analysis of these arrangements — which constitute an innovation in legal practice and originate in the contractual autonomy of insurers and reinsurers — will be conducted from a comparative perspective, drawing upon Spanish and Italian legislation and legal scholarship, and taking into consideration the experience developed within both legal systems.

En 2014 el Legislador español acometió una amplia e importante reforma del Derecho marítimo nacional y, con ella, puso fin a la vigencia del Libro III ("Del comercio marítimo") del Código de Comercio de 1885 y de otras Leyes especiales. &#13;
El emprendimiento de dicha tarea supuso una oportunidad para actualizar, codificar y homogeneizar el Derecho marítimo español (principalmente de índole jurídico-privado). También para introducir novedades en las distintas modalidades contractuales y, entre esas renovaciones, las referentes al coaseguro.&#13;
La navegación marítima convierte a los riesgos en riesgos de naturaleza especial e impone la necesaria distribución de los mismos entre distintas entidades aseguradoras como modo de actuación en dicho ámbito. El acuerdo en virtud del cual los aseguradores asumen parcialmente los riesgos de la navegación constituye el principal elemento característico del coaseguro que en un escenario como el marítimo se convierte en necesario.&#13;
El objetivo de este trabajo es, atendiendo al carácter específico del coaseguro y desde una perspectiva jurídica, examinar dicha modalidad de contratación del seguro marítimo y el alcance de la misma a la luz de la nueva legislación marítima española.; In 2014 the Spanish Legislator undertook a comprehensive and important reform of national maritime law and, with it, repealed Book III ("On maritime trade") of the Commercial Code of 1885 and other special Acts.&#13;
That work was an opportunity to update, codify and homogenize Spanish maritime law (mainly of a private-legal nature). It was also an opportunity to introduce novelties in the different contractual modalities and, among those renewals, those relating to co-insurance.&#13;
Maritime navigation converts risks into risks of a special nature and requires the necessary distribution of them between different insurers as a means of acting in this area. The agreement whereby insurers partially assume the risks of navigation constitutes the main characteristic element of the co-insurance which in a scenario such as maritime becomes necessary.&#13;
The aim of this project is, taking into account the specific nature of co-insurance and from a legal perspective, to examine that modality maritime insurance and its scope in the light of the new Spanish maritime legislation.

Ballesta Luque, Gabriel
Reinsurance is one of the most important contracts in the international arena but it lacks detailed regulation in most legal systems.&#13;
The purpose of this study is to seek, identify and set out the fundamental principles in order to describe the nature of the maritime reinsurance contract. Thus, by means of these principles, the intention is to highlight the role of this concept as the basis of the international insurance system and to highlight its differences with the insurance contract in the strict sense of the word. The relevance of maritime reinsurance is explained by its usefulness, especially in international trade, since without this contract no shipping or insurance activity could operate.

La mayor parte del tráfico comercial mundial se realiza a través del mar y los riesgos de la navegación son cubiertos por seguros marítimos. Sin embargo, la actividad aseguradora precisa del reaseguro, es decir, de un ulterior negocio jurídico que divide y distribuye el riesgo.&#13;
El reaseguro es un auténtico y verdadero contrato de seguro pero cuenta con una configuración particular que lo caracteriza como modalidad asegurativa. La trascendencia económica del mismo hace oportuno también su estudio jurídico. &#13;
A través del análisis de los caracteres del reaseguro se pretende visibilizar el fin y la función técnico-económica del mismo como base del sistema asegurador internacional, explicar su compleja estructura contractual y significar sus similitudes o diferencias con el contrato de seguro directo.; Most of the world's commercial traffic is carried out by sea and the risks of navigation are covered by marine insurance. However, the insurance business requires reinsurance, that is to say, a subsequent legal business that divides and distributes the risk.&#13;
Reinsurance is a real and true insurance contract but has a particular configuration that characterizes it as an insurance modality. The economic importance of it also makes its legal study appropriate.&#13;
The analysis of the characteristics of reinsurance is intended to make visible the purpose and technical-economic function of reinsurance as a basis for the international insurance system, explain its complex contractual structure and signify its similarities or differences with the direct insurance contract.
