abstract = {La regla general de la incompatibilidad absoluta que sigue rigiendo las relaciones de concurrencia entre las prestaciones por desempleo y el trabajo por cuenta propia, contrasta con las actuales tendencias político-jurídicas a flexibilizar el rigor de esta proscripción desde una perspectiva finalista de promoción del autoempleo. Esta corriente disruptiva quedó tímidamente manifestada en los dos únicos supuestos que, de manera excepcional, permiten simultanear prestación y actividad por cuenta propia, pero sobre todo encuentra su máximo exponente en la doctrina judicial configurada durante la última década sobre la materia. Lo que ha desembocado en una disonancia entre el plano normativo y judicial que sigue sin ser corregida pese a la oportunidad que para ello suponía el RD-Ley 2/2024, de 21 de mayo, inspirado en la misma lógica de no penalizar la reincorporación al trabajo.},
abstract = {The general rule of absolute incompatibility, that continues to govern the relationships between unemployment benefits and self-employment, contrasts with the current political-legal tendencies to relax the rigor of this prohibition from a perspective of promoting self-employment. This disruptive trend was timidly manifested in the only two cases that, exceptionally, allow unemployment benefit and self employment to be combined, but above all it finds its maximum exponent in the judicial doctrine configured on the matter. This has caused a dissonance between the normative and judicial level that remains uncorrected, despite the opportunity provided by the RD-Ley 2/2024, of 21 May, inspired by the same logic of not penalizing the back to work.
