abstract = {En los arts. 109 y 110 de la LECrim se estipula, desde 1882, el ofrecimiento de acciones a ofendidos y perjudicados en el proceso penal español como consecuencia de una conducta que también constituye un delito, así como la última oportunidad que tienen ambos para personarse en el proceso. Desafortunadamente el legislador no estuvo preciso en la distinción de ambas figuras. Una confusión que ha aumentado desde que en 2015 el proceso penal español ha incluido el concepto de víctima, según lo dispuesto en la Directiva 2012/29/UE del Parlamento y del Consejo de 25 de octubre de 2012, que establece el estatuto mínimo de derechos, apoyo y protección de las víctimas de los delitos, incluso en el Código Penal que utiliza la noción de víctima con un contenido cambiante. La reciente reforma legal de la LECrim, LO 8/2021, no ha disipado la confusión, por lo que resulta imprescindible distinguir las diversas figuras legales para poder diferenciar el estatuto de cada una en el proceso penal y en el Código Penal.},
abstract = {Since 1882 arts. 109 and 110 of LECrim provide, in the Spanish criminal proceeding, the legal basis of the right to information and advice of the aggrieved parties and those who have suffered a harm as a result of a behaviour which also implies a criminal conduct, and the last chance for both of them to become a party in the criminal proceeding. Unfortunately, the distinction between both legal entitiesis not quite clear. A confusion that has increased since in 2015 the Span ish legal system includes the notion of victim according to the Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 establishing minimum standards on the rights, support and protection of victims of crime, even in the Criminal Code which employs the notion of victim in many different ways. The recent legal reform of the LECrim, LO 8/2021, has not solved the con-fusion so it is essential to distinguish those legal entities in order to be able to under-stand the different status of each of them in the criminal proceeding and the Criminal Code.},
