abstract = {En el presente artículo analizamos la
función ejercida por los promotores fiscales
durante procesos por violación incoados
en la capital chilena, Santiago, entre 1876
–tras la promulgación de la normativa que
reguló sus funciones– y 1927 –año en el
que fueron suprimidos–. Tras considerar su
papel como representantes de los intereses
del conjunto social, buscamos ahondar en
su práctica procesal relativa a un delito
cuya tipificación no estuvo exenta de importantes
controversias interpretativas y
que, pese a ser el epítome de la violencia
sexual masculina ejercida contra mujeres y
niñas, mantuvo un carácter mixto, situado
entre lo público y lo privado. Mediante
la revisión de un cuerpo documental
conformado por leyes, doctrina y expedientes judiciales, abordamos la manera
en la que desempeñaron sus funciones de
acusación e investigación, preguntándonos
sobre qué variables intervinieron en sus
argumentaciones y si es posible identificar
reconfiguraciones, quiebres o cambios en
las tendencias observadas.},
abstract = {In this article we analyze the function
exercised by prosecutors during
rape proceedings initiated in the Chilean
capital, Santiago, between 1876 –after the
promulgation of the law that regulated their
functions– and 1927 –the year in which
they were abolished–. After considering
their role as representatives of the interests
of society, we seek to delve into their procedural
practice relating to a crime whose
characterization was not exempt from
important interpretative controversies.
A crime that, despite being the epitome
of male sexual violence against women
and girls, maintained a mixed character,
located between the public and the private.
Through the review of a documentary body
made up of laws, doctrine and judicial files, we approach the way in which prosecutors
carried out their accusation and investigation
functions, asking us about what variables
intervened in their arguments and if
it is possible to identify reconfigurations,
breaks or changes on the observed trends.},
