abstract = {Este artículo aborda el delito de estupro en el siglo XVII desde un doble punto de vista: legal y literario.
En cuanto al primero, se han estudiado los rasgos generales del tipo penal y sus aspectos sociales.
Seguidamente, se han analizado un conjunto de alegaciones judiciales relativas a este delito. En cuanto
a la literatura, a partir de un extenso corpus de textos, se han examinado los desvíos más frecuentes
respecto a la realidad jurídica (mujeres vestidas de hombres, venganzas inverosímiles, «matrimonios
resolutivos»). También se ha puesto de relieve cómo textos legales y literarios se complementan en la
construcción de un concepto complejo y plurisignificativo del estupro en la cultura barroca.},
abstract = {This paper addresses the crime of rape in the seventeenth century from a double point of view: legal
and literary. Regarding the first point, general elements of the criminal type and its social aspects and,
subsequently, a set of judicial claims affected by this crime have been analyzed. Regarding the second
point, the most common differences from the legal reality (cross-dressed women, implausible revenges,
«decisive marriages») have been examined from an extensive corpus of literary texts. It has also been
highlighted how legal and literary texts fit each other in the construction of a complex and multi-meaning
concept of rape in Baroque culture.},
