abstract = {A pesar de que el causante haya incluido en su testamento una sustitución vulgar, la determinación de a quién corresponde la herencia repudiada resulta a veces compleja. Este trabajo tiene por objeto analizar y proponer criterios de solución en varios supuestos en los que concurre esa complejidad, como sucede cuando quien repudia es un descendiente del causante sustituido por sus propios descendientes; cuando se produce la transmisión del ius delationis y el transmisario repudia bien la herencia del primer causante o bien la del transmitente; o cuando la misma forma de disponer del testador, unida a las circunstancias particulares de la sucesión, plantea dudas sobre cuál es su voluntad en relación a la atribución de la herencia repudiada. Todo ello desde una perspectiva tanto dogmática como práctica, y con especial atención a las resoluciones de la Dirección General de los Registros y del Notariado que se han pronunciado sobre estas cuestiones.},
abstract = {Despite the fact that the deceased has included a common substitution in his will, the determination of whom the repudiated inheritance corresponds to is sometimes complicated. The purpose of this paper is to analyze and propose solution criteria in several cases in which this complexity concurs, as it happens when the person who repudiates is a descendant of the deceased, replaced by his or her own descendants; when the transmission of the ius delationis takes place and the person who has acquired this right repudiates either the inheritance of the first deceased or that of the transferor; or when the testator´s specific way of stipulating itself, together with the particular circumstances of the succession, raises doubts about what his or her will is in relation to the attribution of the repudiated inheritance. All of this is contemplated from both a dogmatic and a practical perspective, paying special attention to the resolutions of the Directorate General of Registers and Notaries on these matters.},
