abstract = {El presente estudio contiene un primer análisis de la Directiva 2013/11/UE sobre resolución alternativa de litigios de consumo y el Reglamento 524/2013/UE sobre la resolución en línea de litigios de consumo hacen necesario estudios dirigidos. El trabajo tiene por finalidad descubrir cómo afectarán e del impacto que tendrán los nuevos instrumentos sobre los sistemas estatales y también sobre la resolución en línea de litigios de consumo. Con esta finalidad, se ocupa de delimitar las principales obligaciones para los Estados, derivadas de la necesidad de hacer cumplir a las entidades ADR acreditadas unos estándares mínimos de calidad (conocimientos especializados, independencia e imparcialidad; transparencia; eficacia; equidad; libertad y legalidad). También se ocupa de explicar el funcionamiento de la futura plataforma europea, y de la delimitación de sus tareas. El estudio contiene evaluaciones de Derecho comparado, fundamentalmente sobre la adaptación de los sistemas español y británico al nuevo sistema europeo, así como apreciaciones críticas sobre los textos europeos, e información sobre cuáles han sido algunos de los puntos calientes en la negociación y redacción final de ambos textos.},
abstract = {This study provides a first analysis of the Directive 2013/11 / EU on alternative resolution of consumer disputes and Regulation 524/2013/ EU on the online resolution of consumer disputes. The work aims to discover how the new European instruments will affect Member States Law and the impact they will have on the online resolution of consumer disputes. To this end, it deals with defining the principal obligations for Member States arising from the need to adapt their ADR entities to minimum standards of quality (expertise, independence and impartiality, transparency, effectiveness, fairness, liberty and legality). It also provides with explanation on the functioning of the future European platform, and its main tasks. The study contains comparative law assessments, mainly on the adaptation of the Spanish and British systems to the new European system,  critical appraisals on European texts, and information on what have been some of the hot spots in the negotiation and finalization of both texts.},
