abstract = {El trabajo ofrece un análisis profundo sobre la historia y evolución del seguro marítimo dentro del marco legal español y, en particular, examina desde las ordenanzas medievales y los Códigos de Comercio del siglo XIX hasta la implementación de la Ley de Navegación Marítima de 2014. Se destaca cómo el seguro marítimo ha pasado de ser un instrumento de protección comercial básica a un sistema normativo complejo que busca adaptarse a las nuevas realidades tecnológicas. Además, la obra subraya la importancia de la autonomía de la voluntad y la necesidad de un futuro código que unifique la dispersión legislativa actual. Finalmente, se reflexiona sobre los retos jurídicos contemporáneos que enfrenta el sector ante la globalización del transporte por mar.},
abstract = {The paper offers an in-depth analysis of the history and evolution of marine insurance within the Spanish legal framework and, in particular, examines its development from the medieval ordinances and the nineteenth-century Commercial Codes to the enactment of the Ley de Navegación Marítima. It highlights how marine insurance has evolved from a basic instrument of commercial protection into a complex regulatory system aimed at adapting to new technological realities.
Furthermore, the study underscores the importance of party autonomy and the need for a future codification that would unify the current legislative fragmentation. Finally, it reflects upon the contemporary legal challenges facing the sector in light of the globalization of maritime transport.},
