abstract = {La utilización de herramientas tecnológicas en los procesos transfronterizos puede contribuir a mejorar el acceso a la justicia, simplificar trámites, reducir costes y agilizar los tiempos judiciales. Para ello, es necesario disponer de soluciones tecnológicas adaptadas al entorno transfronterizo, así como de un marco normativo que respalde su uso mediante un diseño jurídico capaz de garantizar tanto una mayor eficiencia como la protección de los derechos fundamentales. Es perentorio diseñar un nuevo sistema de cooperación judicial internacional en el ámbito iberoamericano que permita una comunicación ágil y específica, sustentada en el uso de las nuevas tecnologías. El presente estudio tiene por objeto analizar los logros y las iniciativas emprendidas por el legislador europeo para digitalizar la cooperación judicial civil internacional, con el fin de valorar si, la Conferencia Interamericana de Derecho Internacional privado, podrían adoptarse algunas de las fórmulas previstas en el marco europeo para tal fin.},
abstract = {The use of technological tools in cross-border proceedings can contribute to improving access to justice, simplifying procedures, reducing costs and speeding up proceedings. This requires technological solutions adapted to the cross-border environment, as well as a regulatory framework that supports their use through a legal design capable of guaranteeing both greater efficiency and the protection of fundamental rights. There is an urgent need to design a new system of international judicial cooperation in the Ibero-American area that allows for agile and specific communication, based on the use of new technologies.
