abstract = {En las últimas décadas, el avance de las nuevas tecnologías y el fenómeno
de la digitalización han supuesto la transformación de las estructuras laborales
convencionales favoreciéndose la aparición de una nueva figura revolucionaria con
caracteres vanguardistas: el nómada digital. Esta innovadora, pero aún desconocida
modalidad de trabajo plantea grandes desafíos a nivel internacional a los que el Derecho
Internacional Privado (DIPr.) debe dar contundentes soluciones. En concreto, es urgente
arrojar luz sobre la determinación de la competencia judicial internacional y la ley
aplicable en aquellos conflictos en que intervengan nómadas digitales, tratándose así de
llenar las lagunas normativas que puedan surgir en las actuales reglamentaciones
europeas y de adaptar los conceptos analógicos del DIPr. a las nuevas tecnologías. Con
este objetivo, se realizarán interesantes propuestas de lege ferenda que puedan servir de
inspiración y orientación al legislador europeo para el impulso de futuros instrumentos
normativos que se adapten a las demandas de esta nueva Era Digital.},
abstract = {In recent decades, the advancement of new technologies and the
phenomenon of digitalization have led to the transformation of conventional labor
structures, favoring the emergence of a new revolutionary figure with avant-garde
characteristics: the digital nomad. This innovative, yet still unfamiliar, mode of work
poses significant challenges internationally, to which Private International Law (PIL)
must provide decisive solutions. Specifically, shedding light on the determination of
international judicial competence and the applicable law in conflicts involving digital
nomads is urgent. This aims to fill regulatory gaps that may exist in current European
regulations and adapt analog concepts of PIL to new technologies. With this objective,
interesting proposals for lege ferenda will be made, which can serve as inspiration and
guidance to the European legislator for the promotion of future regulatory instruments
that fully adapt to the demands of this new Digital Era.},
