La prescripción es una institución perteneciente al ámbito del orden publico y fundada en la seguridad jurídica en virtud de la cual se extinguen los derechos y acciones. Tanto la doctrina como la jurisprudencia exigen un tratamiento restrictivo de la misma por no estar fundada en intrínseca justicia. La interrupción merece un tratamiento ampliador por cuanto supone una voluntad valida y oportunamente manifestada que se dirige a ejercitar conservar o reconocer el derecho. Por tanto todo acto de un sujeto legitimado aun cuando sea un tercero vinculado a la relación jurídica que se realice a través de un cauce legalmente establecido si cumple los requisitos exigidos ha de ser dotado de la eficacia interruptiva que con el se persigue.
