Normas de presupuestos mínimos de protección del patrimonio cultural en argentina: ¿Posibles y vigentes?

Abstract

El establecimiento de normas de presupuestos mínimos de protección fue constitucionalizado en Argentina en 1994 en lo que se refiere al ambiente y al patrimonio cultural. Sin embargo, existen discordancias respecto de la posibilidad de su aplicación sobre este último, así como con respecto al alcance de una eventual norma de estas características. El presente trabajo pretende fundamentar la aplicación de estas leyes en el ámbito del patrimonio cultural en Argentina. Para ello, aborda el contenido y naturaleza jurídica de estas normas y su funcionamiento en un Estado federal para posteriormente rastrear algunos instrumentos jurídicos de protección mínimos vigentes, los cuales pueden considerarse normas germinales.

The setting of minimum protection standards regarding the environment and cultural heritage was constitutionalized in Argentina in 1994. However, there are disagreements about their application to cultural heritage as well as concerning the scope of a possible regulation of this type. This paper aims to support the implementation of these standards in the field of cultural heritage in Argentina. For this purpose, the paper not only analyses the content and legal nature of these rules and their implementation in a federal state, but also traces some current minimum legal protection instruments which might be considered germinal standards.
