La Justicia en la representación parlamentaria del Quinientos: las Cortes de Castilla y los Estados Generales

Abstract

En las dos grandes monarquías europeas del Quinientos, Francia y España, la justicia es, sin lugar a dudas, la virtud por excelencia. Los teóricos de ambos países lo recuerdan con insistencia y aconsejan a los soberanos que la justicia se administre con igualdad. Pero junto a la imagen idealizada de la justicia que recorre los dos reinos, es posible rastrear tanto en España como en Francia críticas feroces contra la administración de justicia propiamente dicha, a la que muchos consideraban aquejada por innumerables problemas. Las Cortes y los Estados Generales —en los que, como es bien sabido, el conjunto del cuerpo social hacía oír su voz— dan testimonio de esta corriente de opinión.

Within the two largest European monarchies of the sixteenth century, France and Spain, justice is, undeniably, the ultimate virtue. Scholars from both countries insistently remind us of this and advise monarchs that justice be enforced equally. But next to the idealized image of justice going through both realms, it is also possible to track both in Spain and France a firm criticism against the enforcement of justice itself, which many deemed afflicted by numerous problems. Courts and General States —where, as we know, the whole of the social entity had to be heard— witnessed this particular trend in views.
