Nacionalidad y ciudadanía: una relación a debate

Abstract

Este trabajo analiza la respuesta que el Estado español, como Estado-nación, está dando a la integración del inmigrante como ciudadano. Frente a quienes consideran que la residencia ha de ser la vía de acceso a la ciudadanía ante la crisis del Estado nación y la movilidad geográfica que impone la globalización económica a las personas, aquí se defiende,por el contrario, la relevancia política de la nacionalidad, como parte alícuota individual de pertenencia al poder constituyente, en relación armónica con un concepto flexible de residencia. La investigación está dividida en cinco apartados, en los que se estudia la nacionalidad y el poder constituyente, las vías de acceso a la nacionalidad española, el conflicto Estado o nación, las peculiaridades de la nacionalidad originaria y, finalmente, los criterios que los Estados utilizan para la selección de la inmigración potencial.El recorrido crítico por la legislación española en materia de nacionalidad y ciudadanía acompañado de los debates teóricos al respecto, ha permitido concluir con una propuesta de lege ferenda centrada en una reforma radical en materia de nacionalidad.

This work analyses the response that the Spanish State as a Nation-State, is giving to integration of the immigrant as citizen. Contrary to those who consider that residence has to be the access way to citizenship in the face of the crisis of the Nation-State and the geographical mobility that the global economy imposes on people, here the political relevance of nationality is defended, as an undivided individual share of belonging to the constituent power in a harmonious relation with the flexible concept of residence. This research is divided into five sections, in which nationality and the constituent power, the ways of access to Spanish nationality, the conflict of Nation or State, the characteristics of original nationality and finally, the criteria used by States to select the potential immigrant. The critical analysis of the Spanish legislation on nationality and citizenship together with the theoretical debates, have enabled us to conclude with a proposal of lege ferenda focussed on a radical reform of the concept of nationality.
